ITE in Castile and León: the technical inspection at 40

If you carry out an ITE in Castile and León: the building has its first inspection in the year after it turns 40 and repeats it every 10 years, depending on the size of the municipality. Here is which buildings need it, what the report covers, who signs it, where it is filed and how you prepare the inspection in ArquiFlow.

The rule in brief

Report
The inspección técnica de edificios (ITE), formerly inspección técnica de construcciones: a statement that the inspection was carried out, with its report as an inseparable annex (Ley 5/1999, art. 110; Planning Regulation, art. 317.1).
Regulation
Ley 5/1999 on planning in Castile and León, art. 110, and the Planning Regulation (Decreto 22/2004), arts. 315 to 318 ter, as worded by Decreto 6/2016.
Buildings
Every building in municipalities of 20,000 inhabitants or more, and in those of 5,000 or more within the stable functional areas; only non-single-family residential buildings in the other municipalities of 5,000 to 19,999, and in those of 2,000 to 4,999 with a general plan or within those areas (art. 315 bis).
First inspection
Within the calendar year after the building turns 40 from its completion, taken from the final works documentation; a full rehabilitation restarts the count (art. 316).
How often
Within the calendar year after 10 years have passed since the previous one (art. 316.2).
Who signs
A competent technician under the LOE to design or direct the works for that type of building, or to direct their execution; the energy performance certification and the accessibility assessment may be signed by other technicians (art. 317 bis).
Who files it, and where
The owners, or the community for the whole building, file the statement and the report at the town hall within the month after they are issued (arts. 315 ter and 318.1).
Result
Safety, health, appearance, accessibility and habitability, with the energy performance certification and the works in a schedule of deadlines, the urgent ones apart; the inspection is visual and covers at least half the floor area (art. 317).

Where to check and where to file

The regional government (Junta) lists which municipalities require the ITE, and each town hall receives its own. These are the pages a technician uses.

What sets the Castile and León ITE apart

  • Full or partial, by municipality

In large municipalities every building has it; in medium ones and small ones with a general plan, only non-single-family residential buildings. The Junta's list of municipalities says which applies in each (art. 315 bis).

  • With defects

If the report lists defects, the ITE takes effect once a competent technician attests that the works are done, and that document is filed at the town hall within the following month (art. 318.3). If there is a risk to people, the technician tells the owners and the town hall at once (art. 318 ter.1).

  • Not filing it on time

The town hall may allow up to 3 more months and then carry out the inspection at the owners' expense (art. 318.2). Not doing it is a minor planning offence (art. 348.4.d), with a fine of 1,000 to 10,000 euros (Ley 5/1999, art. 117.1.c).

  • Valladolid

Ordinance published in the BOP of 4 January 2019: the ITE is filed in the format of the Junta's program, goes into the regional register whatever its result, and the technician's statement marks it favorable, favorable with defects or desfavorable; only a favorable one shows the duty to conserve is met.

  • León and Salamanca

León (BOP of 1 December 2025): favorable or desfavorable, and after a desfavorable one, 3 months to apply for a licence or lodge the responsible declaration for the works; the report notes any asbestos found. Salamanca (BOP of 21 November 2022): favorable, favorable with minor defects or desfavorable, and no licence without an ITE except for minor works.

  • Burgos

Ordinance published in the BOP of 21 December 2012: every year it displays a roll of the buildings that are due, and that display counts as notice; an overdue building gets no licence, except for minor interior works.

In ArquiFlow

In the technical inspection report you choose the IEE regime, because the Castile and León ITE brings together conservation, accessibility and energy performance certification.

You grade each defect by element, and the report records the conservation result, accessibility with its reasonable adjustments and the energy performance certification details, with the works the technician proposes.

The statement and the report the owners file are generated with the ITE|IEE CyL program the Junta promotes, in the format town halls such as Valladolid or León ask for, and the owners file them at the town hall.

  1. You choose the regime

Catalonia's IITE, the IEE (building assessment report), a municipal ITE or the Euskadi ITE (Decreto 117/2018). The report shows the building's details and the fields that regime asks for.

  2. You record the defects

Each observation in the report carries the building element it affects: façades, roofs, structure, installations…

  3. You grade them

Each defect carries its grade: minor, important, serious or very serious.

  4. And you note the verdict

On an IEE, the report records the conservation verdict, accessibility with its reasonable adjustments and the energy performance certification details.

Frequently asked questions

From what age does a building need the ITE?

The first, within the calendar year after it turns 40 from its completion; after that, within the year after 10 years have passed since the previous one. A full rehabilitation restarts the count (Planning Regulation, art. 316).

Does my municipality require the ITE?

It depends on its population and on whether it has a general plan or lies in a stable functional area: in large ones every building has it, in the rest only non-single-family residential buildings. The Junta's list, linked above, gives it municipality by municipality.

Does ArquiFlow file the ITE at the town hall?

No. The statement and the report are generated with the ITE|IEE CyL program the Junta promotes, and the owners or the community file them at the town hall within the month after they are issued.
