ITE in Aragon: the periodic inspection and Zaragoza's ordinance

If you carry out an ITE in Aragon: the Planning Act covers predominantly residential buildings over 50 years old in municipalities of more than 25,000 inhabitants, every 15 years, and Zaragoza asks for it every 10 under its own ordinance. Here is the Aragonese rule, Zaragoza's and how you prepare the inspection in ArquiFlow.

The rule in brief

Report
The law calls it the periodic inspection of buildings; Zaragoza, the Inspección Técnica de Edificios (ITE). The report deals with the building's state of conservation (art. 260).
Regulation
Decreto Legislativo 1/2014, consolidated text of the Aragon Planning Act, art. 260, and municipal ordinances such as Zaragoza's (BOPZ, 31 October 2002).
Buildings
Predominantly residential buildings over 50 years old in municipalities of more than 25,000 inhabitants; planning or an ordinance may mark out other areas with their own duty, limited or not to listed or protected buildings (art. 260.1 and 2).
First inspection
The law sets no date for the first one. In Zaragoza, within the year after the building turns 50 from its construction or an equivalent full rehabilitation, or within 6 months if the city expressly requires it (ordinance, art. 31).
How often
The law, every 15 years (art. 260.1); in Zaragoza, within the year after 10 years have passed since the previous deadline (ordinance, art. 31).
Who signs
A competent technician, who describes the defects, their likely causes and the recommended measures in order of priority, and states how far earlier inspections' recommendations have been carried out (art. 260.3).
Who files it, and where
The law lets the town hall ask owners for the reports (art. 260.4). In Zaragoza, the owner files the report and the technical sheet, stamped by the professional college, and they are entered in the building technical inspection register (ordinance, arts. 32 to 35).
Result
In Zaragoza, the report states the favorable result unequivocally; one without a favorable result is not accepted, and the building does not count as inspected (ordinance, art. 35).

The ITE in Zaragoza, step by step

Zaragoza receives the ITE through its e-office or at the planning department's registry, on its own forms. These are the pages a technician uses.

What sets the Aragonese ITE apart

  • What it checks in Zaragoza

The structure and foundations, façades and party walls, roofs, plumbing and drainage, with a location plan and photographs (ordinance, art. 33). Neither the law nor the ordinance asks for an accessibility or energy efficiency assessment.

  • Not filing it on time in Zaragoza

A sanctioning procedure opens and there is no rehabilitation aid; the city orders the inspection with 3 months to comply, then imposes coercive fines of 600 euros, up to three, and may have it carried out at the owner's expense (ordinance, art. 38).

  • The register and licences

Zaragoza keeps a public computerised register holding the planning data, the construction date, the works, the inspections and the defects corrected; a building with its ITE outstanding gets no licences, except for the works it needs to pass it (ordinance, art. 36).

  • The inspection and ruin

Having met the periodic inspection makes the owner presumed diligent if ruin is later declared, and repairs made since the last inspection count towards the ruin threshold (Aragon Planning Act, art. 261).

In ArquiFlow

In the technical inspection report you choose the ITE regime, the one for the municipal inspection of the state of conservation.

You grade each defect by element, with its likely cause and the measures you recommend, and the report records the conservation result; accessibility, which Zaragoza does not ask for, you can leave blank.

The report the owner files follows the city's form, with the technical sheet and the college's stamp in Zaragoza.

  1. You choose the regime

Catalonia's IITE, the IEE (building assessment report), a municipal ITE or the Euskadi ITE (Decreto 117/2018). The report shows the building's details and the fields that regime asks for.

  2. You record the defects

Each observation in the report carries the building element it affects: façades, roofs, structure, installations…

  3. You grade them

Each defect carries its grade: minor, important, serious or very serious.

  4. And you note the verdict

On an ITE, the report records the conservation verdict and whether the building meets the basic accessibility conditions.
